1. Definitions

"Service" refers to the watch repair, calibration, restoration, and related offerings provided by pendinmy. "User" or "Client" refers to any individual who accesses our website or engages our services. "We," "Us," or "Our" refers to pendinmy, located at 42 Lý Tự Trọng, Bến Thành, Quận 1, Hồ Chí Minh 70000, Vietnam. "Agreement" refers to these Terms and Conditions in their entirety.

2. Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our website or services. You must be at least 18 years of age or the legal age of majority in your jurisdiction to enter into this agreement.

3. Service Description

pendinmy provides professional watch repair services including calibration and regulation, crystal and case renewal, and complete mechanical rebuilds. Our services are available to clients who visit our studio in Hồ Chí Minh City or who arrange service through our contact channels. Service availability may vary based on workshop capacity and parts sourcing timelines.

4. Service Process and Client Responsibilities

When you submit a timepiece for service, you represent that you are the lawful owner or authorized representative of the owner. You agree to provide accurate information about the watch's condition and history to the best of your knowledge. You are responsible for collecting your watch within thirty days of being notified that service is complete. We reserve the right to assess a storage fee for watches uncollected beyond sixty days after notification.

5. Estimates, Approval, and Scope Changes

We provide written estimates before beginning work. If during the service process we identify issues beyond the original scope, we will contact you with a revised estimate and proceed only upon your written or verbal approval. Estimates are valid for fourteen days from the date of issue. Final invoices may differ from estimates only when additional work has been explicitly approved by the client.

6. Payment Terms

All prices are quoted in Vietnamese Dong (VND). Payment is due upon completion of the service and before the watch is returned to the client. We accept bank transfer and cash. Payment terms are communicated at the time of the estimate. For services exceeding 30,000,000 VND, a deposit of up to 30% may be requested before work begins.

7. Intellectual Property

All content on our website — including text, images, design elements, and branding — is the intellectual property of pendinmy unless otherwise noted. You are granted a limited, non-exclusive license to access and view our website for personal, non-commercial purposes. Reproduction, distribution, or modification of our content without prior written consent is prohibited.

8. Disclaimers

Our services are provided on an "as is" basis. While we apply professional care and industry-standard methods to every watch we handle, we do not make specific promises regarding outcomes, as the condition and age of timepieces vary widely. We are not responsible for pre-existing defects that are not apparent during the initial assessment. Photographic documentation is provided as a courtesy and does not constitute a warranty.

9. Limitation of Liability

To the maximum extent permitted by Vietnamese law, pendinmy's total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific service in question. We shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of our website or services. This limitation does not apply in cases of willful misconduct or gross negligence.

10. Indemnification

You agree to indemnify and hold harmless pendinmy and its team members from any claims, losses, or damages (including reasonable legal fees) arising from your breach of these Terms, your misrepresentation of ownership of a submitted timepiece, or your unlawful use of our website.

11. Termination

Either party may terminate the service agreement by providing written notice. If you wish to cancel a service in progress, you will be responsible for costs incurred up to the point of cancellation. We may terminate or suspend access to our website at our discretion if we believe these Terms have been violated.

12. Dispute Resolution

These Terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes arising from or related to these Terms or our services shall first be addressed through informal negotiation. If a resolution cannot be reached within thirty days, either party may submit the matter to the competent courts in Hồ Chí Minh City, Vietnam.

13. General Provisions

These Terms constitute the entire agreement between you and pendinmy regarding the matters described herein. If any provision is found to be unenforceable, the remaining provisions shall continue in full force. Our failure to enforce any right or provision shall not constitute a waiver of that right. We may assign our rights and obligations under these Terms without notice. Any notices to us should be directed to the contact information provided below.

14. Changes to These Terms

We may revise these Terms from time to time. Changes become effective upon posting to this page with an updated "Last Updated" date. Your continued use of our website or services after changes have been posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
